1. ELIGIBILITY: NO PURCHASE NECESSARY TO ENTER.
The WGBH Lab American Experience Stonewall Uprising Open Call Contest (the “Contest”) is void where prohibited by law. The Contest is open to legal residents of the fifty United States and the District of Columbia, except Arizona, who, at the time of entry, are at least thirteen (13) years of age (provided however that entrants between the ages of thirteen (13) and seventeen (17) have obtained permission from their legal guardian). By participating in the Contest, each entrant and each winner are hereby deemed to agree to these Official Rules and all eligibility requirements and guidelines of the Contest. The Contest is sponsored by the WGBH Educational Foundation, One Guest Street, Boston, MA 02135 (“WGBH”). The Contest is not open to employees, officers, directors, trustees, and members of their respective immediate families or households, of WGBH, the Public Broadcasting Service (PBS), PBS member television stations, or their respective affiliates, and subsidiaries. By entering, each entrant acknowledges compliance with these Official Rules. Each entrant must meet all eligibility requirements and guidelines for the Contest.

2. HOW TO ENTER:
The contest home page (the “Contest Home Page”) is located at: http://www.thewgbhlab.org/open-call/stonewall/. The Contest begins on November 24, 2010 at 12AM EST and ends on February 14, 2011 at 11:59PM EST (the “Contest Period”).

Entrants are required to create login accounts on the WGBH Lab home page (www.thewgbhlab.org) and YouTube (http://www.youtube.com/create_account). To officially enter, entrants must log in to the Contest Home Page and confirm that they have met the eligibility requirements (including, without limitation, confirming permission from their legal guardian) and have agreed to the Terms of Use for WGBH and YouTube. Entrants will then upload their Video (defined below) using their YouTube account log in. Entrants are also required to provide a name and a brief description (up to 200 characters) for their Video.

All Videos must be received during the Contest Period. Videos received before the date WGBH begins accepting submissions, and/or those Videos that do not meet the guidelines, are not eligible. Incomplete or inaccurate entries are void.

All Videos will be available for public review, community comment and viewer ratings on the WGBH Lab website. While you retain the rights to your original work, WGBH reserves the right to use any information submitted by entrants for any purpose whatsoever. WGBH may also edit and mix Video entries for promotional use. Such promotional use may include uploading the Video to third party websites, which by their terms of use would allow third parties to download and possibly re-use the Video for other purposes, such as private use and commercial and advertising use.

3. ENTRY CRITERIA: The Contest challenges entrants to create a video about the gay rights movement today (the “Video”). The Video must be a verifiably true story and must be produced by the entrant submitting the Video. The Video may be in the style of a documentary, animation or an audio slide show and must be no longer than three minutes (00:03:00) in length. The Video must comply with WGBH’s Terms of Use (http://www.wgbh.org/info/terms.cfm) and YouTube’s Terms of Use (http://www.youtube.com/t/terms). The entrant must obtain permission from all third party copyright holders (including, without limitation, the rights for interviews, music, footage, locations and stills) and people appearing in the Video before submitting the Video on the Contest Home Page. Such permission must include the right for WGBH to broadcast the Video in all manner and media in perpetuity.

4. SELECTION OF WINNER/JUDGING:
Videos will be judged in two rounds according to the following factors: audio quality, broadcast potential, storytelling ability, authenticity, subject relevance, and review and comments from the WGBH Lab community. In the first judging round, WGBH staff will select up to fifteen (15) Videos from all eligible entries. The WGBH staff and a panel of guest judges will then review the fifteen (15) Videos selected in the first judging round and will declare five (5) winners (each, a “Winner”).

The Winners of the Contest will be determined within fifteen (15) business days from the close of the Contest Period.

5. PRIZES:

Each of the five (5) Winners (or their legal guardian if under the age of eighteen (18)) will receive One Thousand Dollars ($1,000) (each, a “Prize”). Terms and Conditions: WGBH reserves the right to substitute the Prize (or portion thereof) with one of comparable or greater value, at their sole discretion in the event of unavailability. Limit: One (1) Prize per person. The Prize is not transferable to another person, and may not be exchanged for a different Prize or redeemed for any other consideration. WGBH makes no, and disclaims, all warranties, guarantees or representations, express or implied, concerning the condition, quality, merchantability, of any Prize.

Any and all federal, state and local taxes, fees and surcharges on prizes, if any, as well as any other costs and expenses associated with Prize acceptance and use not specified herein as being provided by WGBH are the sole responsibility of the Winner (or their legal guardian if the Winner is under the age of eighteen (18)). WGBH will report any individual winnings over $600 (in cash or fair market value of goods or services) in a one year period to the Internal Revenue Service. The Winner (or their legal guardian if under the age of eighteen (18)) will receive a 1099 form from WGBH if WGBH reports any winnings to the Internal Revenue Service.

The Winner agrees to the use of his/her/their name(s) and likeness(es) in publicity without notice or any additional compensation, except where prohibited by law.

6. WINNER NOTIFICATION
The Winner of the Contest (or their legal guardian if under the age of eighteen (18)) must accept or decline the Prize via email within thirty (30) calendar days from receiving email notification that they are the Winner. If the Winner is unreachable via email after thirty (30) calendar days, or if the Winner is unavailable for Prize fulfillment, an alternate Winner will be selected.

The Winner of the Contest (or their legal guardian if under the age of eighteen (18)) will be required to sign and return an Affidavit of Eligibility and a Liability/Publicity Release Form, (collectively, the “Affidavit and Release”) within thirty (30) calendar days after the Winner receives the Affidavit and Release via email. Failure to return the Affidavit and Release in the time noted will constitute forfeiture of the Prize and an alternate winner may be selected in WGBH’s sole discretion.

7. ODDS OF WINNING:
Odds of winning depend upon the number of eligible entries received.

8. DISCLAIMER OF WARRANTIES / RELEASE LIMITATION ON LIABILITY:
WGBH is not responsible for any bodily or personal injury, or property damage, or any other loss resulting from use or attempted use of any component of the Prize.

WGBH is not responsible for entries that are incomplete, illegible, lost, delayed, mutilated or misdirected. WGBH is not responsible for any problems or technical malfunctions, human error, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer online systems, servers or providers, computer equipment, software, failure of entrants on account of technical problems or traffic congestion on the internet or at any website or any combination thereof including, without limitation, losses, damages or injuries to entrant’s or any other person's equipment or other property, or to their persons, related to participation in the Contest. In addition, WGBH will not be in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, in connection with the Contest and/or the Prize(s). Although WGBH attempts to ensure the integrity of the Contest, WGBH is not responsible for the actions of entrants in connection with the Contest, including entrant's attempts to circumvent these Official Rules or otherwise interfere with the administration, security, fairness, integrity or proper conduct of the Contest. The releases hereunder are intended to apply to all claims not known or suspected to exist.

BY ENTERING THE CONTEST, EACH ENTRANT AGREES THAT: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE CONTEST, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND EACH ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (3) EACH ENTRANT'S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND EACH ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF.

In the event WGBH is prevented from continuing with the Contest by any event beyond its control, including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications or equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within the WGBH's control (each a “Force Majeure” event or occurrence), WGBH shall have the right to modify, suspend, or terminate the Contest.

9. GOVERNING LAW / JURISDICTION:
All disputes arising hereunder or in relation to the Contest, or the award and/or use of any Prize, shall be brought solely and exclusively in Boston, Massachusetts.

10. WINNER(S) LIST:
For a list of the winner(s), send a self addresses stamped envelope to WGBH Educational Foundation at One Guest Street, Boston, MA 02135, Attention: WGBH Lab Stonewall Uprising Open Call Contest.
